We hereby advise all users to read these
terms and conditions and to leave the site immediately if
they cannot agree with them.
OUR COMPANY & WEBSITE
1.1 Thrive floristry take no responsibility
and makes no representations or guarantees in respect to the
contents shown on our site and our other product
information. The information stated is in no way binding and
we, at Thrive Floristry, our employees and suppliers are
excluded from liability, with the exception of those
permitted by UK law, to any loss, claim or damage of any
form and nature, in relation to the use of this website and
our promotional material. Your consumer rights are not
affected.
1.2 As far as we are aware the information
on our site is accurate, but we cannot guarantee this
completely and will therefore not take any responsibility
for errors, omissions or inaccuracies. The opinions, reviews
and implications given on this site together with our
promotional material, catalogues and all, are purely the
personal views/tastes/preferences of Claire Cowling of
Thrive floristry and we take no responsibility for your own
actions that are carried out based on any of this
information, advice or ideas. It is our aim to promote good
floristry and the information provided is done so in good
faith for your interest, enjoyment and inspiration.
1.3 Thrive Floristry and our employees &
suppliers are not liable for any problems relating to
website links, services or information provided on or made
available through the site. Accessing these is done at
entirely your own risk. As far as we are aware, the links
given are safe and to reputable sites, but we accordingly
make no warranties and accept no liability to the fullest
extent permissible by law, to guarantee these.
1.4 Any use of the Thrive website must be
for lawful purposes, and must not affect the rights of, or
otherwise devalue the work of Claire Cowling and the company
“Thrive Floristry” and/or our website.

of others’ books) are the sole property of Liz & Claire
Cowling or Thrive Floristry. All copyright rights belong
exclusively to Thrive Floristry (and/or any facet of our company(ies)
– i.e. www.clairecowling.co.uk) and are hereby reserved. The user may
therefore not copy, download, post, republish, or otherwise
use any of the content in any way, with the exception of
personal, non-commercial use. Should you wish to purchase
any imagery to use or have more information on anything
shown, please contact us in writing for permission. We
reserve the right to refuse.
Infringements of our
copyright restrictions will be prosecuted.
SITE MAINTENANCE
3.1 We reserve the right to restrict access
to our site from time to time, to allow for updating,
maintenance and repair or to add new areas to our site.
REGISTRATION AND ACCOUNTS
4.1 You may browse this site without
registering, but by doing so you accept our terms and
conditions and also accept and agree that certain areas of
the site will not be available to you without registering.
4.2 You are responsible for maintaining the
confidentiality of your email address, password and your
account, and are fully responsible for all activities that
occur under all of these. You must notify us immediately of
any unauthorised use of any of the above and/or any other
breach of security. You must ensure that you exit from your
account at the end of each session by “logging out”. We will
not be liable to you or any third party, for any loss or
damage arising from your failure to comply with this
provision. You must also contact us straight away should you
change your email address and inform us of your new address
along with any other change of contact details.
4.3 We reserve the right, without prejudice,
to any other rights or remedies available to us under these
terms or generally at law to suspend, to make modifications
and to terminate your registration/and/or use
of the site immediately upon being made aware of any breach
or potential breach by you of our terms, without prior
notice. You agree that we will not be liable to you or any
third party for any suspension, modification or
discontinuance.
SHOPPING WITH THRIVE FLORISTRY
Contract of sale & payment
5.1 Your contract for purchases made through
the Thrive Floristry website is with Thrive Floristry. By
purchasing from our site you are agreeing that the given
email can be used as a means of communication.
5.2 The contract for the sale of any product
will only take place between you and us, if and when we
accept your order; by the way of an email confirming we have
received payment in full for all the products that have been
ordered. That acceptance will be deemed complete and for all
purposes to have effectively communicated to you at the time
we email you.
5.3 You undertake that all the details that
you have provided us with for the purpose of ordering and
purchasing products and services are correct and that the
card(s) you are using is in your name and have sufficient
funds to cover the costs of the products or services
ordered. If there are any changes to the details supplied by
you, it is your own responsibility to inform us as soon as
possible. May we also remind you that it is a crime to use a
false name or a known invalid credit card to order goods
with. Anyone caught wilfully entering a fictitious order
and/or payment method will be prosecuted to the full extent
of the law.
5.4 Upon booking a place for a workshops,
you will need to either pay the total amount in full, or pay
the appropriate booking fee (which is non refundable) to
secure your place and by doing so are accepting that you
must complete payment of the balance within one months prior to
the workshop date. By booking a place you are entering a
contract of sale. Please also see workshop booking terms.
5.5 We would like to assure you that we
never pass any of your personal or card details to any third
party. Please see our privacy policy.
Sales, prices and promotions
6.1 Prices of goods listed on our site
exclude post and packing charges. This is shown per order
and will be added at the end of the order process. Delivery
is free of charge on orders over a certain value and this is
before any discounts are given, for delivery to one UK
mainland address.
6.2 Special offers run for a limited period
only and are subject to availability. We reserve the right
to amend any prices should they have been accidentally or
incorrectly priced and/or at the end of an offer period. We
also reserve the right, as and when necessary to remove
discontinued items from our website, mail order list &
brochures without prior notice. We do have good
relationships with the publishing houses and other companies
that we buy from, who keep us informed so you should not be
inconvenienced or disappointed.
6.3 Discounts and savings, unless indicated
otherwise, refer to savings on RRP for books, and to our
usual selling price on sundries and other goods. Further
discounts on already discounted items cannot and will not be
applied, including to those customers with thrive
membership, unless otherwise agreed. We also reserve the
right to exclusive online offers at any time, and to end
them without prior notice.
6.4 Prices shown on our website override any
previously stated in our catalogue or other promotional
information.
Delivery
7.1 We endeavour to process orders and
arrange delivery of all our stock lines within two (2)
working days of receiving your order and approval of
payment, and within thirty (30) days should we be awaiting
a delivery of new stock. We will email you with confirmation
of your order and the expected delivery date if there is a
delay on your order, however dates
are only estimated and we cannot guarantee that you will
receive your delivery on this exact date. After 30 days, if
we are still unable to fulfil your order, we will contact
you by email explaining the reason why you have not received
your order, advise the revised estimated delivery date, you
will have the option to either continue waiting or to cancel
your order.
We will send out part orders at our discretion.
7.2 Very occasionally parcels go astray in
the postal/courier system. If you have been waiting for your
delivery more than two weeks after placing your order please contact us and we promise to look into it urgently
for you. As you will appreciate this is out of our control.
International sales and delivery
8.1 We do offer delivery of goods outside
the UK - place your order in the usual manner and pay, then
we will calculate the weight and postage costs and email you
with this for your confirmation and payment authorisation.
We find this is more cost effective than having a standard
charge per book as this often works out much more costly.
You should be aware that they may be subject to cross border
inspection by the customs authority and therefore may be
opened. Your delivery may also be subject to import duties
and taxes, imposed at the country of destination. These
charges must be paid by you and we would advise that prior
to ordering with us, you contact your customs office to
check out the expected charge (if & when applicable). You
must comply with your country’s laws and regulations
regarding importing products. We will not be liable for any
charges related to this matter.
YOUR ORDER
Changing or cancelling an order
9.1 Currently, it is not possible for you to
change or cancel your order online, however, you can do so
by emailing us, making sure that you state all essential
details including the order ref number, your name, address,
contact details and product(s) ordered, so that we can track
your order easily.
9.2 You have the right to cancel your order
of goods – no questions asked, for seven (7) working days
following receipt of delivery, and we will give you a full
refund. In this case please return the parcel, either
unopened or in it’s original packaging making sure that the
goods are also unopened and sufficiently protected, to
ensure safe and undamaged returned goods to us. We regret
that we cannot offer a full refund for opened and/or damaged
goods or goods that have been damaged in return transit.
Carriage for returns is made at your own cost. Please also
see our return policy.
Damaged or faulty goods
10.1 All our books and sundries are checked
thoroughly prior to dispatch to ensure they are in top
quality condition (unless you have purchased a product which
has been stated as damaged). Any damages that have therefore occurred
in transit should be reported to us on receipt by email for
advice on the appropriate action. In this instance we will
of course refund you the return postage and forward a fresh
copy (or goods if sundries) to you upon receipt and
confirmation of damage claim. Please obtain proof of postage
when returning your order. Many of our books are shrink
wrapped, so should there be a printers fault on any of the
pages, please let us know as soon as possible. In these
instances, we will refund you the return postage and forward
a fresh copy to you upon receipt of damaged/faulty book.
Returns
11.1 We are happy to accept returns and make
exchanges, but have to make the following provisos:
Returned books must be unopened and in
perfect condition. All our books are checked for damage
thoroughly prior to despatch to ensure they are in top
quality condition. We cannot accept returns for books that
are opened from their packaging, due to copyright of the
product and further resale value. We feel that once a
product is opened and you have looked through it, used a few
ideas… the decision has been made to keep it. All other
items must be unopened, unused and in their original
packaging. Items are returned at the customer’s own cost.
Postage and packing charges will not be refunded, unless
otherwise agreed by us. An administration charge of 5% will
be deducted from the selling price of the goods. We would
always recommend obtaining a certificate of posting.
11.2 Until we physically receive the goods
you are returning (or exchanging), they are your
responsibility. For your protection and peace of mind, we
recommend you send them by special delivery or at least to
obtain a Certificate of Postage.
11.3 We reserve the right to withhold a
percentage of the refund value if the item needs to be
reduced in price for resale, due to damage (amount depending
on the damage), or used and/or not in its original
packaging.
Exchanges
12.1 If you would like to return something
to be exchanged, please return the product unopened and well
packaged, with details of the product it is to be exchanged
for. We will send you an email to let you know when we have
received your parcel back and that your exchange is on its
way back to you! Should there be a difference to pay, please
enclose payment details with your returned goods. Any credit
due will be refunded to you. You are responsible for payment
of the postage charges both ways. We cannot exchange opened
and/or used goods.
Statutory rights
13.1 Your statutory rights allow you to
return goods up to 28 days from date of purchase. Therefore
you may return any product(s) bought from Thrive Floristry
within 28 days of purchase, by notifying us in writing and
returning the goods unopened and in their original
packaging, in “as new” condition. Please ensure they are
packaged well to avoid damage as we cannot refund the cost
of goods that are damaged in return transit.
GENERAL
15.1 Although we do allow photography of our
work and designs which are created at our workshops and at
shows we
respectfully ask you not to use photographs of work by Liz &
Claire Cowling for your own promotional use, including use
in portfolios or on your own website. We also ask this
of our books and magazines. The work is solely for
inspiration and should not be copied in every respect and
then promoted as your own. Infringement of this copyright will be
prosecuted.
15.2 Our website is intended mainly for the
UK market, and complies with the current English laws. We
cannot guarantee that it will comply with laws outside the
UK and will not be held responsible in this case.
15.3 We may amend these terms and conditions
from time to time and place a new version on our site. Your
use of the site from the date the amended terms are placed
on the site onwards will be governed by those new terms.
15.4 These terms shall supersede any and all
other conditions, ongoing agreements, understandings and
representations relating to your purchase.
15.5 These terms are subject to the laws of
England and Wales, whose courts shall be the courts of
exclusive jurisdiction.
The terms WE and US mean Thrive Floristry,
YOU mean the visitor/customer.
